Gun Charges

gun1Defense of Weapon Charges in Alaska

Alaska is a big second amendment state. The right to keep and bear arms is important to many of us. However, if you find that law enforcement has charged you with a weapons offense, this is a serious charge with serious consequences, including forfeiture of your weapon and losing your rights to own or possess firearms in the future.

At Law Offices of Robert Herz, P.C., we have experience defending individuals with felony or misdemeanor weapon charges including:

  • Displaying a gun during a road rage incident
  • Drunk or under the influence and in possession of a gun
  • Dealing drugs while possessing a gun
  • Felon in possession of a weapon (status crime)
  • Domestic violence with the threat of a firearm

Weapon Charges Carry Longer Sentences

If there are two charges in combination, such as a gun charge and a drug charge, or a burglary charge and a gun charge, the sentencing becomes more severe. You may be facing a longer sentence if convicted.

If we cannot get charges dismissed and our client does not want to pursue a trial, our law firm has been successful in negotiating agreements to eliminate the weapons portion of the charge in exchange for a guilty plea or lesser plea on the other portion of the criminal charge, thus avoiding the most severe penalties in such a case. At the Law Offices of Robert Herz, P.C., we know how to obtain results that are most beneficial to our clients.

Defense in Federal Court

If your weapons charge involves allegations of felon in possession or possession of stolen firearms or other charges such as a felony drug charge, you may be charged in federal court. If that is the case, you need an attorney with federal court experience. The prosecutors are better and the cases are more thoroughly investigated by the police, FBI or DEA. There are also harsher sentencing rules.
